Now on Friday the Supreme Court has said that it will consider listing the petitions challenging the decision to abrogate Article 370. According to the information, senior advocate Raju Ramachandran had demanded for this. On this, Chief Justice Justice DY Chandrachud said, ‘Okay, I will take a decision on it.’
At the same time, when asked about the decision of the Chief Justice, advocate Raju Ramachandran said that a demand was made in this matter in December 2022 as well. On this again the Chief Justice said, ‘We will consider and give a date.’ Apart from Chief Justice DY Chandrachud, Justice PS Narasimha, Justice JB Pardiwala were also included in the bench hearing the case.
According to the information, the petitions filed against it in 2019 were sent to the constitution bench of Justice NV Ramana, Justice Sanjay Kishan Kaul, Justice R Subhash Reddy, Justice BR Gavai and Justice Suryakant. Hearing on Article 370 cases started before a 5-judge bench in December 2019, almost four months after the notification issued by the Center in August 2019. A preliminary issue raised in this case was whether the matter should be referred to a 7-judge bench in view of the views expressed by two coordinate benches of the Supreme Court in the cases of Prem Nath Kaul and Sampat Prakash .
