RAWALAKOT: (Azadi Times) A three-member bench of the Supreme Court of Azad Jammu and Kashmir (AJK) dismissed the writ petition filed against the AJK High Court decision regarding the speeches of newly appointed chairmen of development institutions in Azad Kashmir and upheld the High Court’s decision.
Ordered to dismiss the chairmen of all the development institutions of Azad Jammu Kashmir and hand over the charge of these institutions to the officers of the Public Works Department who meet this criterion.
In a writ petition filed by Rashid Afraz against the appointment of Chairman Aamir Jameel. Aamir Jameel was appointed on 16-08-2022 and this notification was challenged on 05-09-2022. was not followed and this matter was taken to the Supreme Court. A three-member bench of the Supreme Court, which included Justice Raja Saeed Akram (Chief Justice), Justice Khawaja Muhammad Naseem, and Justice Muhammad Younis Tahir, heard.
Retaining the decision to relieve the newly appointed chairmen of all development institutions including Mirpur, Muzaffarabad, and Rawalakot. And the charge of this post has also been ordered to be handed over to the Chief Engineers of the Public Works Department and the SE.
The Supreme Court referred to the Local Government Act 1990 in the judgment and wrote that development agencies are performing the same tasks assigned to local bodies under the Local Government Act 1990, including 72 types of tasks, so the government for them. Created uniform rules and regulations, earlier the High Court had directed to adopt the rules of developmental institutions under the federal government and also directed to make rules for appointments. After this decision of the court, the respective chairmen left the charge.
