Jammu and Kashmir Legislative Assembly on 28th day of May, 2021 and
received the assent of the President on the 15th day of June, 2021, is hereby
published for general information.

An
Act
further to amend the Azad Jammu and Kashmir Local Government Act,
1990


Whereas, it is expedient further to amend the Azad Jammu and
Kashmir Local Government Act, 1990 (Act VII of 1990), for the purposes
hereinafter appearing;
It is hereby enacted as follows:-

  1. Short title and Commencement.- (1) This Act may be called the
    Azad Jammu and Kashmir Local Government (Amendment) Act, 2021.
    (2) It shall come into force at once.
  2. Amendment of Section 2,Act VII of 1990.- In the Azad Jammu and
    Kashmir Local Government Act, 1990 (Act VII of 1990), hereinafter
    referred to as the said Act, in Section 2,-
    (i) clause(xi) shall be omitted;
    (ii) after clause (lxvii) new clause (lxviii) shall be added as under,-
    “(lxviii) “Youth” means a person having age between 18-35
    years;”
  3. Amendment of Section 5, Act VII of 1990.- In the said Act, in
    Section 5, existing section shall be renumbered as subsection (1) and
    thereafter following amendments shall be made,-
    (i) clause (a) of subsection (1), as renumbered above, shall be
    omitted; and
    (ii) after subsection (1), following new subsection (2) shall be
    added,-

    “(2) As far as practicable, variation in population for local
    council shall not ordinarily exceed 10%:
    Provided that, if the limit of 10% exceeds in an
    exceptional case, the authority shall record reasons thereof in
    the delimitation order.”
  4. Amendment of Section 8, Act VII of 1990.- In the said Act, in
    Section 8, after sub-section (1) following new sub-section (1-a) shall be
    added:-
    “(1-a) The women and youth members equal to 12.5%each of the total
    number of seats, subject to minimum of four i.e., two women
    and two youth, shall be elected by the directly elected members
    of the Union Council.
  5. Amendment of Section 9, Act VII of 1990.- In the said Act, in
    Section 9, sub-section (4)shall be substituted as follows:-
    “(4) The women and youth members equal to 12.5% each of the total
    number of seats, subject to minimum of four i.e., two women and two
    youth, shall be elected by the directly elected members of the district
    council.
    Explanation: For working out the number of women and youth
    members mentioned in this sub-section, a fraction of 0.5 and above
    shall be counted as one.”
  6. Omission of Section 10, Act VII of 1990,- In the said Act, Section
    10, shall be “omitted”
  7. Amendment of Section 11, Act VII of 1990.- In the said Act, in
    Section 11, after sub-section (1) following new sub-section (1-a) shall
    be added:-
    “(1-a) The women and youth members equal to 12.5% each of the total
    number of seats, subject to minimum of four i.e., two women
    and two youth, shall be elected by the directly elected members
    of the town committee.”
  8. Amendment of Section 12, Act VII of 1990.- In the said Act, in
    Section 12, sub-section (4) shall be substituted as follows:-

    “(4) The women and youth members equal to 12.5% each of the total
    number of seats, subject to minimum of four i.e., two women and two
    youth, shall be elected by the directly elected members of the
    Municipal Committee.
    Explanation: For working out the number of women and youth
    members mentioned in this sub-section, a fraction of 0.5 and above
    shall be counted as one.”
  9. Amendment of Section 12-A, Act VII of 1990.- In the said Act, in
    Section 12-A, sub-section (4) shall be substituted as follows:-
    “(4) The women and youth members equal to 12.5% each of the total
    number of seats, subject to minimum of four i.e., two women and two
    youth shall be elected by the directly elected members of the
    Municipal Corporation.
    Explanation: For working out the number of women and youth
    members mentioned in this sub-section, a fraction of 0.5 and above
    shall be counted as one.”
  10. Amendment of Second Schedule, Act VII of 1990.- In the said Act,
    in the Second Schedule,-
    (i) in Part I, in clause (b) of entry no.
  11. 1, for the words “twenty-one”
    the words “eighteen” shall be substituted;
    (ii) in Part II, in entry no. 3, after the word “age” the words “and
    having Secondary School Certificate or equivalent, from a
    recognized board,” shall be added.

NDP’s Hasnain Geelani, Senior Journalist Muhammad Shakeel, Irshad Mahmood, Shaukat Majeed Advocate, Chaudhry Arif, Chaudhry Munir Hussain, Altaf Hameed Rao, Dr. Zubair Qazi, Hafiz Maqsood, Taimur Akbar, Ms. Asma Advocate, Mishkoor Ahmed Mughal, Ms. Efifa Owais, Dr. Waqaz Ali and others also addressed. Former Chief Justice Muhammad Azam Khan said that the holding of local body elections is a wonderful development. Women cannot be empowered without imparting quality education under the Devolution Plan. Justice Azam Khan suggested that to empower the local government in the real sense, reforms should be made in the Local Government Act after the election, a new chapter of construction and development will open in Azad Kashmir. He said that the provision of quality education is very important for the empowerment of youth and women. Health Minister Dr. Nisar Ali Abdali said that despite all the difficulties and reservations, the PTI government is conducting local elections because we promised in the manifesto that we will transfer the power to the lower level after coming to power. He said that all the stakeholders have agreed to conduct local elections and no organization is an obstacle in its way. He said that I am in favor of student politics, but avoiding the possibility of academic crisis and conflict in educational institutions, a system has to be created which can restore student politics without causing national damage. Former minister and central leader of Muslim League-Nun, Chaudhary Muhammad Saeed while speaking said that the local bodies have to be empowered politically and financially. A system should be created where elected representatives are able to generate their own resources. He suggested that a District Finance Board should be formed so that each district and village could receive direct government funding. On the basis of population, area and poverty, the government should allocate grants to districts and then district local union councils to devolve power and funds to the grassroots level. This formula can open the door to development and prosperity. PTI leader Zulfiqar Abbasi said that our villages and cities cannot be clean and orderly until their effective management system is entrusted to the elected representatives of the local government. . He said that our government is excited to hold local body elections because it is in line with Imran Khan’s political vision. Coordinator of SDGs for Azad Kashmir Syed Ali Hasnain Gilani said that achieving the Sustainable Development Goals set by the United Nations is not possible without the establishment of a local government. He said that fortunately Azad Kashmir is ahead in achieving development goals compared to other provinces of Pakistan. People’s Party Women Wing President and Member of Assembly Nabila Ayub said that women have different problems and needs which men cannot solve. Therefore, it is necessary to increase the effective representation of women in elected positions. The low representation of women in the politics of Azad Kashmir can be compensated by increasing the representation of women at the local government level. Representation of women in local bodies should be at least 25 percent. He emphasized that political parties should give more tickets to women so that they can gain confidence and be able to participate in national level politics. There will be a nuclear change in the political and social structure. He said that at least 30 percent of the development budget should be given to the local government. He said that the local government election will prove to be a game changer. A grassroots network of political parties will be established. They will not need to create an organizational setup for the party. PPP Shaheed Bhutto leader Chaudhry Munir Hussain said that local government system means a new economic and political process that will bring positive change in our society. Senior Journalist Mohammad Shakil said that facilities like education and health come under the jurisdiction of local governments. This system can be effective only if it is empowered. Former secretary Shaukat Majeed said that for the establishment of empowered local government system, the government of Azad Kashmir, especially the MLAs, must agree on the allocation of funds. The host of the event, Dr. Waqaz Ali, while delivering the closing remarks, said that the local government can play a key role in combating the climate change that our country is facing. He said that this was the third dialogue of the CPDR and this series will continue so that the gap between the civil society and the decision-making forces is reduced. There are training centers. Speakers Gilgit (PR) Grand Jirga organized by Awami Action Committee Gilgit-Baltistan held at a local hotel in Gilgit. Central Anjuman Tajran Registered, Pakhtun Welfare, Nagar Supreme Council, Pashtun Residents, Civil Society Constituency 3, Shopping Malls Association, KNM, High Court Bar, Awami Workers Party Gilgit-Baltistan, Red Worker Front, Anjuman Hussaini Nagar, Jamaat Leaders and officials of other organizations including Islamic, Flour Mills Association participated.

The meeting unanimously announced a protest sit-in at Etihad Chowk from October 21 against the abolition of wheat subsidy, the Revenue Act 2022, unnecessary increase in electricity rates, and the establishment of a new intermediate board. Addressing the meeting, the Chairman of Awami Action Committee Fidah Hussain, Founding Chairman Ehsan Advocate, Former Chairman Sultan Raees, Chief of Awami Workers Party Comrade Baba Jan, Sheikh Shabir Hakimi, Maulana Tanveer, Former Chairman of KNM Mumtaz Nagri, G.B.

UM leader Fida Hussain and others said that Gilgit-Baltistan is a disputed region, where the imposition of taxes, removal of wheat subsidies, and other black laws are illegal. Minerals and mountains are being looted illegally and efforts are being made to alienate the people on their land, which the two million people here will not tolerate.

Addressing the Grand Jirga, the speakers said that the current assembly is a fake assembly. which is protecting the interests of the rulers of Islamabad instead of protecting the rights of the people, this assembly does not speak in favor of the people, but these members are running a knife on the neck of their people in collaboration with Islamabad.

The speakers further said that now the people of Gilgit-Baltistan cannot be divided into sects and regions and fight among themselves because the people are now conscious and know how to fight for their rights.

At the end of the meeting, a sit-in was also announced in Gilgit from October 21 in favor of the demands.
