The name of Banjonsa Lake cannot be changed: AJK Supreme Court

Banjonsa: (The Azadi Times) The Supreme Court granted the review petition filed by Chhota Gula regarding the change of the historical name of Banjonsa Lake.

The Supreme Court of Azad Jammu Kashmir (AJK) in its written judgment said that the Collector issued a notification in 1995 which has no legal status. The Collector/Commissioner had no authority to issue any order.

The Supreme Court further said that the record shows that the petitioner had earlier filed a similar petition for revision of the judgment of 2022 which was dismissed on 13-10-2022. The petitioner then filed the petition.

Re-hearing of such past closed cases is not considered. The petitioner has referred to the Collector’s script though the Collector has no legal authority to do so and hence the petition is dismissed on the ground that it is not admissible for revision.

 

On the court decision, Hon’ble Banjosa said that some people of Chhota Gula had filed a petition for correctness stating that the name of Banjosa Lake in the Supreme Court’s decision between PDI and Forests was wrong, which was accepted by the Supreme Court.

The historical name of Banjonsa Lake was retained while excluding it. Remember that a few people were trying to change the name of Banjonsa Lake for a long time and institutions were being blackmailed on the basis of some fake documents. Chota Gula that the illegal actions of a few people have damaged tourism as well as government property.

These people tried to erase the historical status of Banjonsa Lake and spread hatred on social media. They damaged the official signboards on which the name of Banjonsa was written. Apart from this, these people also violated the National Action Plan by doing illegal wall chalking.

 

The people of Banjunsa, Jandali, and Chhota Gula area are demanding from the administration of Poonch and related institutions to take legal action against these persons by filing cases of taking the law into their hands, damaging government property and illegal wall chalking. It should be remembered that the Banjonsa community had also filed an application to be a party to this review petition.

 

The people of the Union Council Banjonsa are grateful to the Chief Justice of the Supreme Court, who gave a quick and clear decision on this serious issue in light of the facts. And decided to retain the historical name of Banjonsa Lake.

 

The people of Banjunsa region especially congratulate the committee members Sardar Haleem Rafiq, Khalid Akbar, Qamar Irshad, Manzoor Hussain, Wasif Hussain, Zahoor Hussain, and Javed Akram who worked day and night and finally got success with the help of Allah.

Also, the legal team is grateful to all the friends of the Banjonsa community abroad who have always encouraged us and we have been able to restore our historical heritage.
